Terms of Service

Please read these Terms of Service (“Terms”) carefully before using SuitYourFace (“Service”, “we”, “us”). By creating an account or making a purchase you agree to be bound by these Terms.

1. The Service

SuitYourFace provides an AI-powered professional headshot generation service. You upload a set of personal photographs; we fine-tune a private AI model on those photos and generate one or more studio-quality portrait images for your personal and professional use.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service you represent and warrant that you meet this requirement. The Service is available to individuals and businesses worldwide except where prohibited by applicable law.

3. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must notify us immediately at support@suityourface.com if you suspect unauthorised access to your account.
  • You are responsible for all activity that occurs under your account.

4. Acceptable Use of Photos

By uploading photographs you confirm that:

  • The photos contain only your own likeness or the likeness of individuals who have given explicit written consent for AI training.
  • You own or have the legal right to use all uploaded photos.
  • The photos do not depict minors.
  • The photos are not obscene, illegal, or otherwise prohibited.

We reserve the right to suspend accounts that upload photos in violation of these requirements without refund.

5. Payments and Pricing

The Service is provided on a one-time payment basis. All prices are displayed in USD and are inclusive of applicable taxes where required. Payments are processed securely by Stripe, Inc. We do not store your payment card details.

Your payment grants you a single headshot generation. Additional generations may be purchased separately. See our Refund Policy for details on refunds and disputes.

6. Intellectual Property

Upon successful payment and delivery of your generated headshot(s), you are granted a worldwide, non-exclusive, royalty-free licence to use the generated images for personal and commercial purposes including LinkedIn profiles, resumes, company websites, press kits, and marketing materials.

You may not:

  • Resell, sublicense, or redistribute the generated images as stock photography or AI training data.
  • Claim the AI model itself as your intellectual property.
  • Use the images for any unlawful purpose.

SuitYourFace retains ownership of the underlying AI models, software, and infrastructure.

7. AI-Generated Content & EU AI Act Transparency

Our headshots are generated by artificial intelligence. While we strive for realistic, high-quality results, AI outputs are not guaranteed to be perfect likenesses. Results may vary depending on the quality and quantity of photos provided. We do not guarantee that any generated image will meet specific professional standards, pass identity verification, or be accepted by any third party.

In accordance with EU AI Act Article 13 transparency requirements, we disclose the following:

  • The Service uses AI to process biometric facial data (your uploaded photos) to generate portrait images. Your portraits are AI-generated.
  • The AI system is not used for real-time remote biometric identification in publicly accessible spaces. It is not within the prohibited or high-risk categories under EU AI Act Articles 5 and 6 as currently interpreted.
  • The gender information you provide is used solely to generate style-appropriate portraits and has no other automated decision-making effect on you.
  • The AI does not make consequential automated decisions about you within the meaning of GDPR Article 22. You have the right to request human review of any AI-related matter by contacting support@suityourface.com.

8. Prohibited Activities

You agree not to:

  • Use the Service to generate images of real people without their consent.
  • Attempt to reverse-engineer, scrape, or copy the AI models or underlying infrastructure.
  • Circumvent payment requirements through technical means.
  • Upload malware, malicious scripts, or other harmful content.
  • Abuse the Service in a way that degrades performance for other users.

9. Service Availability

We aim to provide a reliable service but do not guarantee 100% uptime. AI training and generation may be delayed due to third-party provider capacity. If your order cannot be fulfilled within 72 hours of payment, you are entitled to a full refund.

10. Limitation of Liability

To the maximum extent permitted by law, SuitYourFace shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of profits, loss of data, or reputational harm.

Our total aggregate liability to you for any claim arising from these Terms shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Australian Consumer Law: nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded.

11. Indemnification

You agree to indemnify and hold harmless SuitYourFace, its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms or your use of the Service.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may close your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately and we may delete your data in accordance with our Privacy Policy.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to your rights as a consumer under the law of your country of residence.

14. Alternative Dispute Resolution (EU)

If you are a consumer in the European Union, you may use the European Commission’s Online Dispute Resolution (ODR) platform to resolve disputes: ec.europa.eu/consumers/odr/. Our email for ODR purposes is support@suityourface.com. We are not obligated to use ADR but will consider all reasonable complaints through our support process.

15. Changes to These Terms

We may update these Terms from time to time. We will give at least 14 days’ notice before material changes take effect by emailing registered users. Continued use of the Service after changes constitutes acceptance of the updated Terms.
